GENERAL TERMS AND CONDITIONS

1) Scope

1.1 These General Terms and Conditions (hereinafter "GTC") of Florian Reimann

apply to all contracts for the delivery of goods that a consumer or business (hereinafter "Customer") concludes with the Seller regarding the goods and services offered in the Seller’s online shop. The inclusion of the Customer’s own terms is hereby rejected.

A consumer is any natural person who enters into a transaction that is not part of the operation of their business. A business within the meaning of these GTC is a natural or legal person or a legally responsible partnership that, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity. Public limited companies, limited liability companies, cooperative societies, mutual insurance associations, savings banks, European Economic Interest Groupings (EEIG), European Companies (SE), and European Cooperatives (SCE) are businesses by virtue of their legal form.


2) Conclusion of contract

2.1 The product descriptions contained in the Seller’s online shop do not constitute binding offers by the Seller but serve to submit a binding offer by the Customer.

2.2 The Customer can submit the offer using the online order form integrated into the Seller’s shop. After selecting and configuring the goods or services and completing the electronic ordering process, the Customer submits a legally binding offer regarding the goods in the shopping cart by clicking the button that concludes the order process. The Customer then receives an automatic confirmation of receipt of the order. This confirmation does not yet constitute acceptance of the offer.

2.3 The Seller can accept the Customer's offer within three working days by:

  • sending a written order confirmation or an order confirmation in text form (e.g., by email), whereby receipt of the confirmation by the Customer is decisive; or

  • requesting payment from the Customer after the order has been placed.

If both occur, the contract is concluded at the earlier point in time. The period for acceptance begins the day after the Customer submits the offer and ends at the close of the third working day following submission. If the Seller does not accept the Customer’s offer within this period, this is considered a rejection, and the Customer is no longer bound by their declaration of intent.

2.4 The order data is archived on the Seller’s website and can be accessed by the Customer via their password-protected user account, using the appropriate login data, free of charge.

2.5 The contract language is German and English.

2.6 Order processing and communication generally take place via email and automated order processing. The Customer must ensure that the email address provided is correct so that emails sent by the Seller can be received. In particular, when using spam filters, the Customer must ensure that all emails sent by the Seller or third parties commissioned by the Seller can be delivered.


3) Right of withdrawal

3.1 Consumers residing in the EU generally have a right of withdrawal when concluding a distance contract. Please refer to the withdrawal information for details.

A distance contract is a contract between the Seller and a consumer that is concluded without the simultaneous physical presence of the Seller and the consumer, with exclusive use of distance communication means (email, internet, phone) up to and including the conclusion of the contract.


4) Prices and payment terms

4.1 Unless otherwise indicated in the Seller’s product or service description, the prices stated are total prices including statutory VAT but excluding shipping costs. Shipping costs are calculated during the ordering process once the recipient address is entered.

4.2 For deliveries to countries outside the EU, additional costs may apply in individual cases, which are not the Seller's responsibility and must be borne by the Customer (e.g., money transfer fees, import duties, customs).

4.3 Accepted payment methods: credit cards, PayPal, Amazon Pay, Apple Pay, Google Pay, Shop Pay, and direct debit (SEPA).

4.4 Delivery is carried out by Österreichische Post and DPD.


5) Retention of title

5.1 The Seller retains ownership of the goods until full payment of the purchase price has been received.


6) Delivery and shipping conditions

6.1 We deliver to Germany, Austria, and Switzerland.

6.2 Delivery is made to the delivery address specified by the Customer.

6.3 If delivery fails due to reasons for which the Customer is responsible, the Customer bears the reasonable costs incurred. This does not apply to shipping costs if the Customer effectively exercises their right of withdrawal.

6.4 If the Customer is a business, the risk of accidental loss or damage to the goods passes to the Customer once the Seller has handed the item over to the carrier. For consumers, risk passes only upon delivery.

6.6 In the event of delivery delays due to force majeure (e.g., pandemic, strike, disaster, war), the delivery period is extended by the duration of the delay. Claims for damages are excluded. The Customer retains the right to withdraw after setting a reasonable deadline.


7) Warranty / Liability

7.1 The statutory warranty provisions apply.

The Seller is liable for ensuring that the goods have both the agreed properties and the objectively required properties unless the Customer expressly consents to a deviation at the time of purchase.

For businesses:

  • Minor defects do not give rise to warranty claims.

  • The Seller may choose the type of remedy.

  • The warranty period does not restart upon replacement delivery.

  • The Customer is subject to the obligation of inspection and notification of defects under § 377 UGB.

The Seller is not liable for slight negligence, except in cases of personal injury.


8) Jurisdiction / Applicable law

8.1 Austrian law applies, excluding the UN Sales Convention. For consumers within the EU, this applies only insofar as the protection granted by mandatory legal provisions of the consumer’s home country is not withdrawn.

8.2 The competent court at the Seller’s registered office has exclusive jurisdiction for disputes with businesses.

8.3 Place of performance is the Seller’s registered office.


9) Alternative dispute resolution

This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer.
